Bertin Bertrand Tchuente, fonctionnaire retrait\u00e9, n\u2019a plus droit de cit\u00e9 \u00e0 Nkongoa, un village situ\u00e9 \u00e0 un jet de pierre de Mfou. Bien que propri\u00e9taire dans ce village d\u2019une maison d\u2019habitation et des plantations r\u00e9alis\u00e9es sur un terrain d\u2019une superficie de 3 hectares que couvrait jusqu\u2019ici le titre foncier No 6353\/Mefou Afamba, ce document n\u2019a plus de valeur l\u00e9gale. Et pour cause\u00a0: le 5 janvier dernier, le Tribunal administratif de Yaound\u00e9 a proc\u00e9d\u00e9 \u00e0 son annulation. M. Tchuente est sanctionn\u00e9 pour avoir obtenu le titre all\u00e9gu\u00e9 par voie d\u2019immatriculation directe sans qualit\u00e9 parce que n\u2019appartenant pas \u00e0 la communaut\u00e9 originaire des lieux.<\/p>\n

Etienne Ateba et Th\u00e9ophile Belinga, deux fr\u00e8res, avaient du mal \u00e0 contenir leur joie lorsque cette sentence est tomb\u00e9e. Ils avaient un sourire jusqu\u2019aux oreilles. Ils sont en fait les initiateurs du recours au centre du proc\u00e8s. Une attitude qui contrastait avec la tristesse de M. Tchuente qui pr\u00e9sentait le masque des mauvais jours \u00e0 la fin de l\u2019audience.<\/p>\n

Dans cette affaire, les fr\u00e8res Ateba et Belinga repr\u00e9sentants de la collectivit\u00e9 coutumi\u00e8re Onanda, expliquent \u00e0 travers leurs recours qu\u2019ils ont h\u00e9rit\u00e9 des terres disput\u00e9es de leurs d\u00e9funts parents et grand-parent qui les ont toujours exploit\u00e9es et occup\u00e9es depuis des lustres. Mais \u00abcontre toute attente\u00bb ils ont \u00e9t\u00e9 surpris de d\u00e9couvrir que M. Tchuente qui n\u2019est pourtant pas membre de leur communaut\u00e9 a r\u00e9ussi, de mani\u00e8re frauduleuse, \u00e0 obtenir le titre foncier attaqu\u00e9e sur le domaine national \u00e0 la suite d\u2019une proc\u00e9dure d\u2019immatriculation directe. Or seules les collectivit\u00e9s coutumi\u00e8res sont habilit\u00e9es \u00e0 immatriculer le domaine national.<\/p>\n

En effet, les deux fr\u00e8res estiment que l\u2019immatriculation querell\u00e9e a viol\u00e9 les dispositions de l\u2019article 9 du d\u00e9cret du 27 avril 1976 fixant les conditions d\u2019obtentions du titre foncier. Selon ce texte\u00a0: \u00absont habilet\u00e9s \u00e0 solliciter l\u2019obtention d\u2019un titre foncier sur une d\u00e9pendance nationale qu\u2019elles occupent et exploitent, les collectivit\u00e9s coutumi\u00e8res, leurs membres ou toute autre personne de nationalit\u00e9 camerounaise, \u00e0 condition que l\u2019occupation ou l\u2019exploitation soit ant\u00e9rieure au 5 ao\u00fbt 1974 [\u2026]\u00bb.<\/p>\n

Protocole d\u2019accord <\/strong><\/span><\/h4>\n

Pour les plaignants, M. Tchuente ne remplit aucune des dispositions list\u00e9es par le texte cit\u00e9, car \u00aben 1974, M. Tchuente n\u2019avait que 2 ans\u00bb. De ce fait, il ne pouvait pas avoir occup\u00e9 et exploit\u00e9 le terrain litigieux pour pr\u00e9tendre \u00e0 l\u2019immatriculation critiqu\u00e9e. Ajout\u00e9 au fait qu\u2019il est originaire d\u2019une communaut\u00e9 non originaire de Nkongoa. Leur avocat indique que M. Tchuente et feu Belinga, le grand-p\u00e8re de ses client avaient conclu \u00abun protocole d\u2019accord\u00bb non notari\u00e9 selon lequel le mis en cause devait l\u2019aider \u00e0 proc\u00e9der \u00e0 l\u2019immatriculation de ses terres et allait en retour recevoir des parcelles de terrains comme r\u00e9tribution. M. Tchuente n\u2019a jamais rempli ses obligations mais s\u2019est empress\u00e9 d\u2019immatriculer en catimini les terrains que le feu Belinga lui promettait.<\/p>\n

C\u2019est un son de cloche diff\u00e9rent que M. Tchuente a fait entendre dans ses \u00e9critures. Il dit avoir achet\u00e9 deux terrains en 2001 aupr\u00e8s de feu Belinga. Ce dernier lui a ensuite \u00abc\u00e9d\u00e9 ses droits coutumiers\u00bb sur ladite parcelle. Des parcelles qu\u2019il a mis en valeur. Ce qui, a ses yeux, lui permet de proc\u00e9der \u00e0 l\u2019immatriculation d\u00e9cri\u00e9e.<\/p>\n

En prenant ses r\u00e9quisitions, le minist\u00e8re public a relev\u00e9 que la proc\u00e9dure d\u2019immatriculation qui a abouti \u00e0 la d\u00e9livrance du titre attaqu\u00e9 est truff\u00e9e de nombreuses irr\u00e9gularit\u00e9s. D\u2019abord, M. Tchuente a acquis le terrain disput\u00e9 \u00e0 la suite d\u2019une vente irr\u00e9guli\u00e8re (sous seing priv\u00e9) parce que faite hors la vue d\u2019un notaire et sur un terrain non immatricul\u00e9. Ensuite, les oppositions formul\u00e9es par certains membres de la famille des plaignants n\u2019ont pas \u00e9t\u00e9 lev\u00e9es, mais l\u2019immatriculation est all\u00e9e jusqu\u2019\u00e0 son terme. Deux ingr\u00e9dients qui ont viol\u00e9 le d\u00e9cret d\u00e9j\u00e0 \u00e9voqu\u00e9. En instruisant l\u2019affaire, le tribunal a effectu\u00e9 une descente \u00e0 Nkongoa pour se faire une opinion sur les faits d\u00e9nonc\u00e9s.
