Il est sanctionn\u00e9 pour une fraude fonci\u00e8re qu\u2019il a commise lors de l\u2019\u00e9tablissement dudit titre foncier.<\/p>\n

C\u2019est Thimot\u00e9 Mfomo Amougou, son partenaire d\u2019affaires, qui a introduit un recours devant la juridiction en 2020 pour solliciter l\u2019annulation de ce titre de propri\u00e9t\u00e9. le plaignant raconte en effet qu\u2019il est propri\u00e9taire de quatre vastes lopins de terre \u00abcoutumiers\u00bb se trouvant \u00e0 Ndong son village natal. Il a fait appel \u00e0 M. Mbida afin qu\u2019il finance la proc\u00e9dure d\u2019immatriculation directe de ses terrains. L\u2019int\u00e9ress\u00e9 disposait d\u2019un d\u00e9lai de 12 mois pour lui faire obtenir des titres de propri\u00e9t\u00e9 sur son patrimoine. Sa r\u00e9tribution allait se faire en nature. En fait, M. Mfomo Amougou s\u2019\u00e9tait engag\u00e9 \u00e0 octroyer \u00e0 son \u00abfinancier\u00bb 10% de la superficie des terrains immatricul\u00e9s. Ce don devait se concr\u00e9tiser par le morcellement des titres foncier attendus. Les deux hommes avaient scell\u00e9 leur deal en signant un protocole devant un notaire en 2011. Mais, bien apr\u00e8s, M. Mfomo a perdu la vue. Il est devenu malvoyant. Le plaignant pr\u00e9tend que M. Mbida a \u00abprofit\u00e9\u00bb de sa c\u00e9cit\u00e9 pour faire remplacer son nom sur la demande d\u2019immatriculation par le sien. Ce maquillage lui a permis d\u2019obtenir le titre foncier \u00e0 l\u2019origine du proc\u00e8s.<\/p>\n

M. Mfomo Amougou s\u2019est essentiellement appuy\u00e9 sur les dispositions de l\u2019article 9 du d\u00e9cret du 27 avril 1976 fixant les conditions d\u2019obtention du titre foncier. Ce texte pr\u00e9cise que seules les collectivit\u00e9s coutumi\u00e8res ou leurs membres sont habilit\u00e9s \u00e0 proc\u00e9der \u00e0 l\u2019immatriculation directe des terres qu\u2019ils occupent ou exploitent. Une condition que M. Mbida ne remplit pas puisque n\u2019\u00e9tant pas originaire du village Ndong. Le mis en cause s\u2019est \u00e9galement appropri\u00e9 ses plantations lors de la descente de la commission consultative conduite par le sous-pr\u00e9fet charg\u00e9e de constater l\u2019occupation ou l\u2019exploitation du terrain \u00e0 immatriculer. Comme mesure d\u2019instruction suppl\u00e9mentaire, le tribunal a effectu\u00e9 une descente au village Ndong. Les informations recueillies \u00e0 cette occasion sans doute permis aux juges de d\u00e9couvrir que la fraude fonci\u00e8re incrimin\u00e9e saute aux yeux.<\/p>\n","protected":false},"excerpt":{"rendered":"
